The sale is conducted by Belnea Sp. z o.o. [Limited] with its registered office in Warsaw [Bitwy Warszawskiej 1920 18, 02-366 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register under KRS number 0000513867, NIP 521-36-74-334, REGON 147292394].
The sale of goods by electronic means is regulated by:
Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144 item 1204 as amended);
Act of 30 May 2014 on the consumer rights (Journal of Laws of 2014 item 827 as amended);
Act of 23 April 1964 Civil Code (Journal of Laws of 2014 item 121 as amended).
PRODUCT PRICE – the gross value of the ordered product expressed in Polish zlotys and including VAT, not including additional costs, i.e., cost of delivery.
DELIVERY – means the delivery to the Customer by the Seller of the ordered goods, through an individually selected supplier. The available forms of delivery may change depending on the options currently offered by suppliers.
SUPPLIER – means an entity cooperating with the Seller and providing services in the field of delivery of ordered goods. The choice of supplier depends on the Customer. Courier companies or operators of post office boxes (parcel lockers) are available.
PASSWORD – a string of alphanumeric characters, necessary for authorization during access to the Account specified by the Customer when creating the Account. Account registration requires the Password to be repeated twice in order to detect and correct any errors. The Customer is obliged to keep the Password strictly confidential (not to disclose it to any third parties). The Seller provides the Customer with a multiple possibility to change the password.
CUSTOMER – an entrepreneur conducting business activity consisting in the provision of cosmetic and cosmetology services in the territory of the Republic of Poland.
ACCOUNT – Electronic Service, marked with an individual name (Login) and Password provided by the Customer set of resources in the IT system of the Seller, allowing the Customer to use additional functionalities/services. The Customer gains access to the Account by using a Login and Password. The Customer logs in to their Account after registering in the Online Store. The Account allows saving and storing information about the Customer's address data for shipping Products, tracking the status of the Order, access to the Order history and other services provided by the Seller.
COST OF DELIVERY – a fee for the delivery of goods to the place indicated in the order by the Customer and located on the territory of the Republic of Poland.
ORDER COST – a fee, the payment of which is the responsibility of the Customer, and which consists of the price of the Product and the cost of delivery. The cost of the Order may be increased by other costs, provided tat the Customer was previously informed about them and agreed to them during the Order.
LOGIN – the Customer's e-mail address provided as part of the Store when creating an Account.
ONLINE STORE – website available at belnea.com.pl through which the Customer can place Orders.
SELLER – Belnea Sp. z o.o. [Limited] with its registered office in Warsaw [ Bitwy Warszawskiej 1920 18, 02-366 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register under KRS number 0000513867, NIP 521-36-74-334, REGON 147292394].
GOODS/PRODUCT – products presented in the Online Store that Customer can order and then buy, according to the content of this Order.
SALES AGREEMENT – a contract for the sale of goods/products at a distance, concluded between the Customer and the Seller, provided that the Customer, after placing the Order, will cover the total costs of the Order.
ORDER – a statement of the Customer's will, submitted to the Seller in order to conclude a Sales Agreement, specifying the type and number of the goods and the form of delivery.

Contact with the Online Store is possible at the registered office address indicated above, at the e-mail address: firstname.lastname@example.org, by phone number +48 691 273 707 and via the social network Facebook or the Messenger on the Seller's profile. Starting a conversation via the Facebook social network or Messenger communicator outside the working hours of the chat service results in sending an automatic message with information that the service will send a reply on the next business day.
Terms of the Online Store use
A prerequisite for placing an order in the Online Store is:
an access to a computer or terminal device with a network connection and a standard web browser installed;
providing data necessary for the correct execution of the Order;
having an active e-mail address to confirm the Order and contact the Seller;
confirmation of reading and acceptance of the Terms and Conditions (Acceptance of the Terms and conditions is voluntary, but necessary in order to create an Account and/or to place an Order by the Customer).
The Seller stipulates that professional Products may only be purchased by a professional conducting business activity consisting in the provision of cosmetic and cosmetology services in the territory of the Republic of Poland. Prior to this, the Customer must undergo verification at the Belnea Customer Service Center (verification includes determining whether the entity actually conducts activities of the aforementioned type).
Creating an Account is required to place an Order in the Online Store.
The Account is provided free of charge for an indefinite period. The Customer has the possibility, at any time and without giving a reason, to delete the Account (resign from the Account).
The Seller has the right to process personal data in connection with the execution of the Order or contact with the Seller via the online form.
The data necessary for the execution of the Order are: company name, shipping address, phone number, e-mail address, name and surname of the contact person, tax identification number.
In addition, the data provided by the Customer may be:
made available to suppliers who provide a paid service for the delivery of ordered goods,
processed for the purpose of issuing a VAT invoice,
processed due to a request or offer of cooperation sent by the Customer via the online form.
In the event of a violation of these Terms and Conditions, the Seller is entitled to transfer the Customer's data to entities authorized to their processing on the basis of applicable law.
Conditions and procedure for concluding Sales Agreements
The Customer can purchase Products only for their daily use in the salon or retail.
The Seller clearly informs Customers about unit prices and Product promotions and Price reductions. In the event of making a promotion (Price reduction) for a given Product, the Seller will indicate the lowest price that was in force within 30 days before the promotion was introduced. In the event of the Product being offered by the Seller for a period of less that 30 days – the Seller will indicate the lowest Price of the Product, which was in force from the moment it was launched for sale until the date of launching the promotion for the Product.
In order to conclude a Sales Agreement through the Online Store operating at: http://belnea.com.pl, it is necessary to select the ordered Product by adding it to the cart and perform all the actions that the Customer is informed about through the messages and information contained on the website.
When placing an order, until the 'Buy and pay' button is pressed - the Customer has the option of modifying the entered data and the Order itself.
Orders can be placed 24 hours a day.
After placing an Order, the Customer will receive, to the e-mail address indicated in the form, an Order confirmation containing the following information:
name and quantity of ordered Goods,
Order costs [Product price including Delivery costs],
selected payment method,
selected delivery method,
bank transfer details.
In order to fulfill the Order, it is necessary to confirm that the present Terms and Conditions have been read and accepted.
Placing an Order by the Customer is tantamount to a statement of will to conclude the Sales Agreement with the Seller.
The Sales Agreement is concluded at the time of sending the 'Order Confirmation' to the Customer's e-mail address.
The order will be accepted for execution if, within 72 hours from the moment of placing the order, the Customer makes the payment, which will be confirmed by the crediting of the entire amount due to the Seller's bank account.
Forms of delivery and payment
Delivery of Products available in the Online Store is executed exclusively on the territory of the Republic of Poland.
The Customer has the opportunity to use the following delivery methods:
DHL courier – cost: 20,04 PLN gross,
InPost courier - cost: 15,92 PLN gross,
InPost Paczkomat - cost: 17,32 PLN gross.
The Cost of Delivery is borne by the Customer, unless the Seller specifies otherwise in the terms of Delivery.
The customer bears the costs of the Order by making a transfer directly to the Seller's bank account.
Delivery of Products to the Customer will take place within no more than 14 days [working days, which are considered to be days from Monday to Friday, excluding days off from work] from the date of payment by the Customer.
The delivery time is indicated each time in the product description.
After completing the Order, the Seller will send a confirmation of the Order to the Customer's e-mail address and begin shipping the Order to the Customer.
Withdrawal from the Agreement
The Customer may withdraw from the Sales Agreement within 14 days without giving any reason.
The period specified in par. 1 begins with the delivery of the Product to the Customer or the person indicated by them.
The Customer may withdraw from the Agreement by submitting a declaration of withdrawal to the Seller [Annex 1 to the Terms and Conditions]. To maintain the period of withdrawal
from the Agreement it is sufficient for the Customer to send a statement before the expiration of the period indicated in the par. 1.
The Seller will immediately confirm to the Customer the receipt of the statement of withdrawal from the contract to the e-mail address provided when concluding the Sales Agreement.
In the event of withdrawal from the Agreement, the Agreement shall be deemed not to have been concluded.
The Customer is obliged to return the purchased Goods to the Seller immediately, but not later than 14 days from the date of withdrawal from the Agreement.
The Customer sends back Goods being the subject of the Agreement from which they have withdrawn at their own expense and risk.
The Seller within 21 days from the date of receipt of the returned Goods shall refund the Cost of the Order without taking into account the cost of shipping the Goods to the Customer.
The Seller has the right to withdraw from the conclusion of the Sales Agreement, in a situation where the Customer has violated the provisions of the Terms and Conditions, in particular:
has provided untrue data that prevent the correct execution of the Order,
has violated the personal property of third parties, including other Customers,
has resold the purchased goods as part of their business activity,
has committed other behaviors that harm the good name of the Seller and are inconsistent with applicable law.
The Sales Agreement covers new products.
In the event of a defect in the Product purchased from the Seller, the Customer has the right to complain on the basis of the warranty provisions in the Civil Code.
The complaint must be submitted in writing or electronically to the addresses of the Seller specified in these Terms and Conditions.
The Seller is obliged to replace the defective item with a defect-free one.
Goods sent back under the complaint procedure must be sent to the address specified in § 5 of these Terms and Regulations.
The Seller shall respond to the complaint immediately, no later than within 14 days from the date of its submission, in accordance with art. 7a par. 1 of the Act, unless the provisions of law or separate regulations stipulate a different period.
Personal data protection
The Administrator of personal data provided by the Customer when using the services of the Online Store is:

Personal data of Customers placing Orders in the Online Store are processed on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Personal data of Customers is stored for the period necessary to perform activities resulting from the services provided, including also made available to trusted business partners (among others courier companies and companies providing IT and accounting services).
Sales Agreements concluded through the Online Store are concluded in Polish.
The Seller reserves the right to amend the Terms and Conditions for important reasons, that is: changes in the law, changes in payment and delivery methods – to the extent that these changes affect the implementation of the provisions of these Terms of Conditions.
Each time the amended regulations will be made available on the website http://belnea.com.pl.
For Sales Agreements concluded before the amendment of the Terms and conditions, the version of the Terms and Regulations in force on the date of placing the Order by the Customer shall apply.
In matters not regulated by these Terms and Conditions, the applicable legal provisions shall apply.
The Terms and Conditions shall come into force on 19 June 2023.
